HCA supports individualism

Wed 11 Nov 2009

The Australian Liberal Students' Federation (ALSF) has today congratulated the High Court of Australia on shifting the responsibility for drunken actions on to the individual by ruling that publicans have no general duty of care.

"This is a victory for common sense," said ALSF President Alex Butterworth.

"It is ridiculous that business owners of any kind should be held responsible for the actions of their customers. Individuals should be held accountable for their own actions, not for the actions of others."

"The High Court's warning against 'interfering paternalism' is one that the Rudd Government should take note of, particularly when considering whether to implement their 122 steps towards the nanny state," Mr Butterworth said.

The ALSF looks forward to the High Court continuing to apply similar common sense principles in future judgements.
